A. TERMS GOVERNING USE OF THE WEBSITE

If you do not agree with any part of these Terms and Conditions (the “Agreement”), you must not use the Website. By using the Website, you agree to be bound by these Terms.

2. Changes to Terms & Conditions

Jolie Gift reserves the right to update or modify these Terms at any time, at its sole discretion. Continued use of the Website after any changes have been posted constitutes your acceptance of the revised Terms. We are not required to notify you of updates individually, so we encourage you to review the Terms periodically to stay informed.

3. Accounts

3.1 Account Creation & Benefits
To access and purchase products via joliegift.com, you must create an account (“Account”) and opt in to receive marketing emails. By registering, you will be able to:
(a) Receive email updates from Jolie Gift
(b) Place and manage orders
(c) Update your preferences (email, address, payment details, etc.)
(d) Access receipts and past order history

3.2 Account Information
You agree to provide accurate and current information when creating an Account and to update it as necessary.

3.3 Account Refusal or Closure
Jolie Gift reserves the right to reject or close Accounts if:
(a) Fraud or illegal activity is suspected
(b) These Terms have been violated
(c) Required by law
(d) Duplicate accounts are identified

3.4 Account Security
You are responsible for all activity under your Account. Keep your login and password secure. Jolie Gift is not liable for any misuse resulting from your failure to secure your credentials.

3.5 Account Deletion & Marketing Preferences
You may request to delete your Account or personal data at any time by emailing contact@joliegift.com. You may also unsubscribe from marketing emails using the links provided in each message.

4. Unauthorised Use of the Website

4.1 Acceptable Use
You agree to use the Website only in accordance with:
(a) These Terms and Conditions
(b) Applicable laws and regulations

4.2 Prohibited Activities
You must not engage in activities that disrupt or harm the Website or its infrastructure. This includes attempts to bypass security measures or access restricted areas.

4.3 Content Restrictions
You must not copy, distribute, or otherwise use content from the Website or Jolie Gift emails unless permitted by law or with written permission from Jolie Gift.

4.4 Fraudulent Use

B. USER AGREEMENT FOR PURCHASES OF PRODUCTS OR SERVICES

1. Legal Capacity

By making a purchase on the Website, you confirm that:

You are at least 18 years of age; and
You are legally capable of entering into a binding contract with Jolie Gift.

If a minor places an order and Jolie Gift suffers any loss or damage as a result, we reserve the right to take legal action to recover compensation from the minor’s parents or guardians.

2. Placing Orders

2.1 Product Display
Products and services displayed on the Website are invitations to treat—not offers for sale. Your submitted order is an offer to purchase under these Terms. We reserve the right to accept or reject any order for any reason, including but not limited to:

Unavailability of the product or service;
Errors in product descriptions or pricing;
Errors in your order.

If we cancel your order, any payment made will be refunded in full. You may cancel an order only if we haven’t begun processing it. A cancellation and restocking fee of 20% of the payment or $10 (whichever is lower) will apply. To cancel, please email contact@joliegift.com.

2.2 Order Modifications
Once payment has been processed, you cannot change or add to your order.

2.3 Address Errors
If your shipping address is incorrect, contact us immediately. We are not responsible for lost orders due to address errors caused by the customer.

2A. Fraud Prevention Protocols

If your payment triggers fraud protection, we may:

Contact you for verification; or
Cancel the transaction and refund your payment.

If you do not respond to verification requests within 7 days, your order will be cancelled.

3. Pricing

All prices on the Website are in Australian Dollars (AUD) and exclude GST. Prices are current at the time of display and may change without notice—but no price change will apply to accepted orders.

4. Payment

If your payment is declined or not received, we cannot reserve or ship the items in your order.

5. Supply of Products

5.1 Delivery Commitment
We will supply products as confirmed in your order. While we aim to meet delivery estimates, delays can occur. We do not offer local pick-up.

5.2 Order Issues
We acknowledge that:

Items may be missed or packed incorrectly;
Orders may be lost or damaged in transit;
Products may arrive faulty.

In these cases, Jolie Gift will only refund or credit the value of the affected products. We do not resend missing items.

5.3 Notification Period
You must notify us of any supply issues within 7 days of receiving your order. Claims outside this period will not be accepted.

5A. Missing Orders in Transit

If your order has not arrived within the stated delivery window, you must contact us within 30 days from your invoice date. Our freight carriers will not accept investigations after this time.

6. Delivery and Freight Charges

Jolie Gift ships throughout Australia. Standard shipping is free for orders over $70 (excluding international orders). We reserve the right to change freight charges at any time.

6.1 Public Holidays
Couriers do not operate on public holidays, so delivery delays may occur around holidays.

6.2 Freight Carriers
We use multiple carriers at our discretion.

6.3 Delivery Timeframes

Local Warehouse Products

Processing Time:
Orders fulfilled directly from our Melbourne location are processed within 1–2 business days of receiving cleared payment. Delivery typically takes 3–14 business days, depending on your location.

Shipping Time (Australia-wide):

Standard Shipping: 3–14 business days
Express Shipping: 1–2 business days (if selected at checkout)

Express Shipping Details:

Available for Local Warehouse Products only, within Australia.
Orders placed before 12pm AEST are dispatched the same day (business days only).
Orders placed after 12pm on Friday or on weekends/public holidays will be dispatched the next business day.
Express shipping rates depend on your location and order weight.
Express shipping is not available for very heavy items.

You will receive tracking information via email once your order is dispatched. For more details, refer to our Shipping Policy.

"Please note that we cannot guarantee the exact date of arrival, and the delivery timeframes (excluding weekends and public holidays) are as follows:

For customers in Victoria, approximately 7-10 working days;
For customers in NSW, SA, ACT, and QLD, approximately 9-12 working days;
For customers in WA, NT, and TAS, approximately 9-12 working days.

Exclusive Orders (Supplier-Fulfilled)

Some items are shipped directly from our trusted third-party suppliers, allowing us to offer a wider variety of products.

Processing Time:
Orders are processed within 2–4 business days of receiving cleared payment..

Estimated Delivery Time:
7–20 business days (depending on the supplier’s location and your delivery address).

Tracking is included with most supplier-fulfilled items and will be shared once your order is dispatched.

Mixed Orders

If you purchase both in-store and supplier-fulfilled products, they may arrive in separate packages and on different dates. We will provide individual tracking information for each part of your order, so you can track them separately.

Note: You understand that we will use our best endeavours to meet stated timeframes for dispatch and delivery, however many factors can affect these timeframes and we cannot guarantee that they will always be met.

7. Delivery and Risk Policy for Jolie Gift

Delivery Responsibility:
Once your parcel has been marked as “Delivered” by the courier’s tracking system, Jolie Gift is no longer liable for any loss, theft, or damage, regardless of whether a signature was obtained.

Authority to Leave (ATL):
If you tick the "Authority to Leave" box during checkout, you authorize the courier to leave your parcel unattended at your delivery address. Jolie Gift is not responsible for any loss or theft after delivery.

No Authority to Leave (No ATL):
If you do not provide Authority to Leave, the courier may attempt redelivery or require a signature based on their own delivery policies. Jolie Gift’s responsibility for the parcel ends once the courier records the parcel as delivered.

Please ensure your shipping address is secure. We recommend using a business address or a location where someone can accept deliveries on your behalf.

7A. Change of Address During Delivery

If you contact the courier to change your delivery address after your order has shipped, Jolie Gift is not liable for lost or misdelivered orders. We recommend against changing addresses once your order is in transit.

8. Returns Policy

At Jolie Gift, we stand by the quality of our products and comply with the Australian Consumer Law (ACL). Our returns policy is designed to address faulty, damaged, or incorrectly described items. We do not accept returns or provide refunds for change of mind.

8.1 Eligibility for Return

You may be eligible for a return, refund, or replacement if the item:

Is faulty or damaged
Does not match the product description
Is not fit for its intended purpose as per ACL standards

To initiate a return, you must contact us at contact@joliegift.com within 14 days of receiving your item. Unauthorised returns will not be accepted.

8.2 Return Conditions

Returned items must meet the following criteria:

Be in original packaging
Be unused and undamaged
Be in resell able condition

Returns that do not meet these conditions may be declined.

8.3 Return Shipping

For eligible returns under ACL, return shipping costs will be covered by us or reimbursed where applicable. In other cases, return shipping is the responsibility of the customer. We recommend using a tracked service, as we cannot process returns lost or damaged in transit.

8.4 Processing of Refunds or Replacements

Once your return is received and inspected, we will notify you of the outcome. Approved refunds will be issued to your original payment method within 10 business days. Please allow additional time for your bank or provider to complete processing.

8.5 Non-Returnable Items

We cannot accept returns on the following:

Perishable goods (e.g., pet food, treats, supplements)
Used or opened pet grooming products
Used pet toys, accessories, or beds
Clearance or Final Sale items
Intimate or sanitary products
Hazardous materials or flammable liquids/gases
Gift cards or digital/downloadable products
Personalized or custom items

Please review product details carefully before purchase.

8.6 Items from Third-Party Suppliers

Some of our items are fulfilled by third-party suppliers. If an issue arises with one of these products, we will coordinate with the supplier to resolve it under the guidance of Australian Consumer Law.

9. Statutory Conditions & Warranties

Under the Competition and Consumer Act 2010, certain statutory warranties apply and cannot be excluded. These apply in addition to any voluntary warranties provided.

For goods:

We may repair, replace, or refund defective items (at our discretion).

For services:

We may resupply the service or refund its cost.

10. Discounts & Promotions

10.1 Discount Codes

One use per customer.
Only one discount code can be used at a time.
Codes for signing up to emails are for first-time use only.

10.2 Exclusions

Discount codes cannot be applied to items already on sale.
Free shipping codes are valid for Australian customers only.

11. Return to Sender

If your parcel is returned to us due to non-collection or address error:

Jolie Gift will not resend the item unless the customer pays for additional shipping.
We may issue a refund for the product value only, minus the original shipping and restocking fees.

12. Product Reactions

Jolie Gift sells pet accessories and products. We do not guarantee product claims and advise that customers consult with a veterinarian before use. We are not responsible for any adverse reactions.

C. GENERAL TERMS

1. Limitation of Liability

Nothing in these Terms excludes or modifies any rights you may have under the Competition and Consumer Act 2010 or other applicable consumer protection laws that cannot be legally excluded.

To the maximum extent permitted by law, Jolie Gift and its related entities, employees, officers, agents, and contractors are not liable for any direct, indirect, or consequential loss or damage suffered in connection with:

Use of the Website;
Purchase or use of any products or services from the Website;
Disruption of the Website;
Any interference with or damage to your computer systems.

This includes, but is not limited to, loss of profits, revenue, savings, or business opportunity.

2. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Jolie Gift, its affiliates, employees, officers, agents, and contractors from any claims, losses, damages, or expenses (including full legal costs) arising from:

Your use of the Website;
Your breach of these Terms and Conditions;
Your purchase or use of any products from the Website;
Any disruption to or interference with your systems related to your use of our Website.

3. Intellectual Property

Jolie Gift retains all intellectual property rights in materials, content, and services provided through the Website.

If Jolie Gift is sold or merged, you agree that your personal information and other data may be transferred to the new owner, without needing prior notice or your consent.

6. Relationship of Parties

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Jolie Gift. You agree that you are acting independently as a customer.

7. Delays Beyond Our Control

Jolie Gift is not liable for delays in fulfilling its obligations—including shipping—caused by circumstances beyond our control (e.g., natural disasters, strikes, pandemics, courier delays).

8. Severability

If any provision of these Terms is found to be illegal, invalid, or unenforceable, that provision will be read down or severed. The remaining Terms will continue in full force and effect.

9. Governing Law and Jurisdiction

These Terms and any related matters are governed by the laws of Australia.

Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
