A. TERMS GOVERNING USE OF THE WEBSITE

If you do not agree with any part of these Terms and Conditions (the “Agreement”), you must not use the Website. By using the Website, you agree to be bound by these Terms.

Jolie Gift reserves the right to update or modify these Terms at any time, at its sole discretion. Continued use of the Website after any changes have been posted constitutes your acceptance of the revised Terms. We are not required to notify you individually, so we encourage you to review the Terms periodically.

3. Accounts
3.1 Account Creation & Benefits
To access and purchase products via joliegift.com, you must create an account (“Account”). You may opt in to receive marketing emails during account creation. You can unsubscribe at any time. By registering, you will be able to:

  • Receive email updates from Jolie Gift

  • Place and manage orders

  • Update your preferences (email, address, payment details, etc.)

  • Access receipts and past order history

3.2 Account Information
You agree to provide accurate and current information when creating an Account and to update it as necessary.

3.3 Account Refusal or Closure
Jolie Gift reserves the right to reject or close Accounts if:

  • Fraud or illegal activity is suspected

  • These Terms have been violated

  • Required by law

  • Duplicate accounts are identified

3.4 Account Security
You are responsible for all activity under your Account. Keep your login and password secure. Jolie Gift is not liable for any misuse resulting from your failure to secure your credentials.

3.5 Account Deletion & Marketing Preferences
You may request to delete your Account or personal data at any time by emailing contact@joliegift.com. You may also unsubscribe from marketing emails using the links provided in each message.

4. Unauthorised Use of the Website
4.1 Acceptable Use
You agree to use the Website only in accordance with:

  • These Terms and Conditions

  • Applicable laws and regulations

4.2 Prohibited Activities
You must not engage in activities that disrupt or harm the Website or its infrastructure. This includes attempts to bypass security measures or access restricted areas.

4.3 Content Restrictions
You must not copy, distribute, or otherwise use content from the Website or Jolie Gift emails unless permitted by law or with written permission.

4.4 Fraudulent Use
Any unauthorised, fraudulent, or illegal use of the Website is strictly prohibited and may be reported to law enforcement.

B. USER AGREEMENT FOR PURCHASES OF PRODUCTS OR SERVICES

1. Legal Capacity
By making a purchase on the Website, you confirm that:

  • You are at least 18 years of age; and

  • You are legally capable of entering into a binding contract with Jolie Gift.

If a minor places an order and Jolie Gift suffers any loss or damage, we reserve the right to take legal action to recover compensation from the minor's parent or guardian.

2. Placing Orders
2.1 Product Display
Products and services displayed on the Website are invitations to treat, not offers for sale. Your submitted order is an offer to purchase under these Terms. We reserve the right to accept or reject any order, including for reasons such as:

  • Product unavailability

  • Errors in product descriptions or pricing

  • Errors in your order (including address or selection errors)

If we cancel your order, any payment made will be refunded in full.

Cancellations must be requested before processing begins. A cancellation and restocking fee of 20% or $10 (whichever is lower) applies. Email contact@joliegift.com as soon as possible.

2.2 Order Modifications
Orders cannot be changed once payment is processed.

2.3 Address Errors
We are not responsible for lost orders due to customer-entered address errors.

2A. Fraud Prevention Protocols
If your payment triggers fraud protection, we may:

  • Contact you for verification; or

  • Cancel and refund your order.

If we do not hear from you within 7 days, your order will be cancelled.

3. Pricing
All prices are in AUD and exclude GST. Prices are current at time of display and may change before purchase. Accepted orders are unaffected.

4. Payment
Items are not reserved or shipped until payment is received.

5. Supply of Products
5.1 Delivery Commitment
We aim to meet estimated delivery times, but delays can occur. No local pick-up is available.

5.2 Order Issues
If items are missing, damaged, or faulty, we’ll refund or credit the value. We don’t automatically resend unless agreed.

5.3 Notification Period
Report issues within 7 days of receiving your order. Late claims will not be accepted.

5A. Missing Orders in Transit
Report undelivered items within 30 days of the invoice date. Our couriers will not investigate after that.

6. Delivery and Freight Charges
Standard shipping is free for orders over $70 (Australia only). Charges may change without notice.

6.1 Public Holidays
Delivery may be delayed around holidays.

6.2 Freight Carriers
We select carriers at our discretion.

6.3 Delivery Timeframes

All orders include tracking, which will be provided via email once your item is dispatched.

Standard Shipping:

1. Melbourne-Based Products (In-Stock Items)

These are stocked locally and dispatched by Jolie Gift.

  • Processing Time: 1–2 business days after receiving cleared payment

  • Dispatch Cutoff Time: Orders placed before 2:00pm (Melbourne time), Monday to Friday, will be dispatched the same day. Orders placed after 2:00pm Friday, weekends, or public holidays will be dispatched the next business day.

  • Delivery Time:

    • Standard Shipping: 3–14 business days

    • Express Shipping: 1–2 business days (see Express section below)

2. Local Warehouse Fulfillment (Australia-Based Partners)

Items are fulfilled from trusted warehouses across Australia.

  • Processing Time: 2–3 business days after receiving cleared payment

  • Estimated Delivery:

    • VIC: 7–10 business days

    • Other states: 9–12 days

Times exclude weekends and public holidays.

3. Exclusive Orders (Supplier-Fulfilled Items)

Select specialty items ship directly from our third-party suppliers, either within Australia or internationally.

  • Processing Time: 2–4 business days after receiving cleared payment

  • Estimated Delivery: 7–20 business days

  • Tracking: Provided via email once shipped

These items may arrive separately from other products in your order.

Express Shipping (Melbourne-Based Items Only)

Jolie Gift offers Express Shipping within Australia only for local, in-stock items.

  • Eligibility: Available only for Melbourne-based products; not valid for items over 5kg

  • Processing Time: 1–2 business days after receiving cleared payment

  • Dispatch Cutoff: Orders placed before 12:00pm AEST are dispatched the same day Orders placed after 12:00pm AEST, on Friday, or during weekends/public holidays are dispatched the next business day

  • Estimated Delivery: 1–2 business days

  • Rates: Calculated based on destination and weight

  • Carriers: Australia Post, Aramex, Sendle, and other trusted partners

Mixed Orders

If your order contains a combination of products (e.g., Melbourne-based, warehouse-fulfilled, and exclusive), items may arrive in separate packages on different dates.

Each shipment will include a separate tracking link.

7. Delivery and Risk Policy
Once marked as “Delivered” by the courier, risk transfers to you.

  • Authority to Leave (ATL): You accept full responsibility for items left unattended.

  • No ATL: Courier may attempt redelivery or require signature.

Secure delivery addresses are recommended.

7A. Change of Address After Dispatch
If you request address changes after dispatch, we are not liable for lost or misdelivered parcels.

8. Returns Policy
We comply with Australian Consumer Law. Faulty, damaged, or misdescribed items may be returned. Change-of-mind returns are not accepted.

8.1 Eligibility
Return requests must be made within 14 days. Items must be:

  • Faulty or damaged

  • Misdescribed

  • Not fit for purpose

8.2 Return Conditions
Items must be unused, in original packaging, and in resellable condition.

8.3 Return Shipping
We cover return costs only for faulty or misdescribed items. Otherwise, customers cover shipping and should use a tracked method.

8.4 Refunds
Refunds are issued within 10 business days to your original payment method.

8.5 Non-Returnable Items
We cannot accept returns on:

  • Perishables (e.g., food, treats)

  • Opened grooming products

  • Used accessories or toys

  • Clearance items

  • Gift cards or digital products

  • Custom/personalised items

8.6 Third-Party Fulfilled Items
We will assist in resolving third-party issues as per Australian Consumer Law.

9. Statutory Conditions & Warranties
Your statutory rights under the Competition and Consumer Act 2010 cannot be excluded. We may repair, replace, or refund goods at our discretion.

10. Discounts & Promotions
10.1 Discount Codes

  • One code per customer and per order

  • Email signup codes are for first-time use only

10.2 Exclusions

  • Not valid on sale items

  • Free shipping codes apply only in Australia

11. Return to Sender
If your parcel is returned due to address error or non-collection:

  • We will not resend without new shipping payment

  • Refunds may exclude original shipping and restocking fees (20% or $10)

12. Product Reactions
Consult a vet before using any products. We are not liable for adverse reactions.

13. Manufacturer Branding Disclaimer
Some items may feature third-party branding. This is not a defect or misrepresentation. Jolie Gift is not affiliated unless stated.

C. GENERAL TERMS

1. Limitation of Liability
To the fullest extent permitted by law, Jolie Gift is not liable for losses arising from:

  • Use of the Website or products

  • Website disruptions

  • Damage to your systems

2. Indemnity
You agree to indemnify Jolie Gift against claims related to:

  • Your use of the Website

  • Breach of these Terms

  • Disruption to your systems

3. Intellectual Property
All Website content is the property of Jolie Gift. Do not copy, reuse, or reverse-engineer any content or source code.

Any content submitted by you (e.g., reviews) may be used by Jolie Gift for marketing and product development purposes.

4. Waiver
Our failure to enforce a right does not waive it. Waivers must be in writing.

5. Privacy

If Jolie Gift is sold or merged, your data may be transferred to the new owner.

6. Relationship of Parties
You are an independent customer. No agency or employment relationship exists.

7. Delays Beyond Our Control
We are not liable for delays due to events outside our control, such as natural disasters or courier issues.

If a clause is found unenforceable, the rest of the Terms remain valid.

9. Governing Law
These Terms are governed by the laws of Australia. Disputes will be handled in Victoria courts.
